About the Studio

Pilates & Co PTY LTD (ABN 32 604 425 970) operates 3 Pilates Studio’s on the Gold Coast, QLD located at 75 West Burleigh Rd, Burleigh Heads 4220, 25 Upton St, Bundall 4217 and 76 Robina Town Centre Drive, Robina 4226. Please read these terms and conditions (the ‘Terms’) carefully. By becoming a member on a direct debit, package, taking a class, paid or otherwise, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the studio, or any of Services, immediately. Pilates & Co reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Pilates & Co updates the Terms, it will use reasonable endeavours to provide you with notice of updates to the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records. 

WAIVER/PERSONAL DECLARATION

Pilates & Co are committed to ensuring the health and wellbeing of all of our studio clients. You are required to inform the studio and our instructors of any health risks, pre-existing injuries, illness, pregnancy, a medical condition or anything that may affect your exercise practice before starting a class. Pilates & Co recommends that you seek medical advice before participating in any classes at our studio’s. Participating in any exercise at our studio’s, online or events is done so at the client/member’s own risk.
I declare as a member or guest utilising any Pilates &Co classes, sessions, online or community and retreat programs etc that I am fit and well to attend. I have been given medical clearance or am I free to exercise. I recognise that teachers or staff at Pilates & Co are not able to provide me with medical advice to my current health. Failure to disclose information from time to time regarding my health condition that may lead to injury, ailment or complaint is solely my responsibility and not that of Pilates & Co. Information provided to Pilates& Co is treated as confidential and will not be shared with third parties or without my written consent.

Instructor methods

All of our instructors will use methods in which they may ‘correct’ or adjust a client’s Pilates poses or exercise form, and as such might make physical contact. This type of instruction is in place to ensure safer practice and limit of injury to clients while exercising. By taking part in a class you acknowledge that you accept this method of instruction and take part in the class at your own risk. 

Schedule changes

Pilates & Co reserves the right to make changes to the class schedules, opening hours, membership pricing and instructors at any time. 

Personal belongings

You are responsible for the loss, theft or breakage of any personal belongings you bring into the studio. We recommend not bringing valuable items into sessions, such as phones, jewelry, wallets or purses. 

Membership Agreements

When signing up to one of our memberships, you must agree to the membership agreement detailed on the Mind Body Pilates & Co store. This agreement authorises the direct debit and lists any conditions specific to your membership package. 

Non-payment of membership

As part of the membership agreement, Pilates & Co reserves the right to refuse entry to classes or cancel bookings if a customer’s account is in arrears and until they bring their account up to date. Pilates & Co will charge a $10 fee to your nominated bank/credit card if the payment is dishonoured. 

Hold Periods on memberships

During your membership period, your account can be placed on hold for number of weeks and payments will be frozen during this time. these are to be done in 1 week increments. Pilates & Co requires 7 business days written notice of a ‘freeze’ / on hold period – sent to info@pilatesandco.com.au.  The minimum term of payments will be required regardless of any hold period chosen. The following periods are allowed for membership types:

  • 1 session per week or 3 month minimum contract term = 3 weeks hold period allowed

  • 2-4 sessions per week and unlimited memberships over 6 month minimum contract term = 6 weeks hold period allowed 

Notice to cancel memberships

All memberships are set to automatically roll over to another membership period. Membership agreements can only be cancelled after the minimum term. If you choose to cancel your membership, written (email) notification to info@pilatesandco.com.au is required 7 business days before the membership is due to roll over or after the initial minimum term is completed to cancel the membership . 

Pricing

Pilates & Co may change these direct debit terms and/or pricing at any time by providing the customer with 30 days advance written notice of such changes. 

Class scheduling, cancellations, and late terms

Allowance of sessions on memberships do not roll over from week to week. It is the member’s responsibility to schedule their own classes using Pilates & Co's online booking system or app. Members must provide 12 hours’ notice to cancel a class. If they do not give this sufficient notice, or they do not show for a booked class the class will be debited from their weekly allowance of sessions or member package. If the member is on an unlimited membership they are billed $10 for a late cancel and $15 for a no show. For the safety and enjoyment of all participants and as studio policy since June 2020 (Covid re-opening) students will not be permitted to enter a class once the class has started and therefore will lose this booked class from there weekly allowance of sessions or member package. This is a strict policy, thanks for your understanding. 2 Minutes late is too late.

waitlist etiquette

Seen a class is on waitlist only, should you add yourself? YES and the likely hood of you getting in the class is very high. This is how it works once you are on the waitlist….

1) You will be automatically added to a class if space becomes available up to 2 hours before class start time

2) If you can no longer make this class take yourself OFF the waitlist, this reduces any fees for you and frees the spot for another

3) Once you are added into the class that space is now yours so late cancellation and no show fees or loss of credit applies (see above terms). You will receive EMAIL confirmation so if you are on a waitlist be sure to keep checking emails and your bookings.

4) With the last 2 hours. No automatic transfer will occur so best to keep checking in this final window period or we may reach out to offer this to you

Refunds

Our membership packages, class packages, casual classes and event tickets are non-refundable and non-transferable. Unused classes are not rolled over to the next period. If a customer is unsatisfied with the services provided by the Pilates & Co or believes that they may be entitled to a refund, then Pilates & Co requires the customer to contact us directly via info@pilatesandco.com.au outlining why you believe you are entitled to a refund attached any medical certificates if relevant so we are able to adequately respond to your request. Please note that a refund made under these circumstances will incur a 10% charge on the amount refunded to cover admin and any direct debit fees. 

Waitlists

It is important you cancel out of a class if you can't make it. This will open up the space for someone else to attend. If you are unsure how to do this please talk to us. If you are on a waitlist and the class is more than 12 hours away (outside the cancellation period) you should be automatically transferred into the class if a spot frees up. It's important to check your bookings regularly. If the class is within 12 hours before the class starts, you will need to check your waitlist and move yourself in. Where possible we will message members within this period to advise you of the vacant spot. Depending on your notifications setting, you may not get the emails or it could be outside of class hours (ie. overnight). We advise members to check regularly and if people can late cancel rather than no show, others are more likely to get a spot. Thanks everyone as we try to ensure people can make classes and no spots are missed.

CHILDREN IN STUDIO

Our insurances do not permit children in the studio. Under no circumstances do we allow children of any age to sit and wait in the studio while classes are on. If you are a parent/carer, it is our desire to create an environment where the focus is solely on your experience and all the other members, with limited distractions. This includes not allowing late comers into class. We appreciate your understanding on this as we try to deliver a safe and happy studio for everyone.
